Kentucky Fried Chicken (KFC) has been ordered to pay Aus$8.3 million to an Australian girl after suffering a severe brain damage and was paralysed after eating Twister wrap.
Monika Samaan suffered a brain injury linked to food poisoning when she was seven in October 2007. The brain injury left her with a blood infection and septic shock.
Other family members of Monika also became ill and claimed Samaan’s injuries, which were severe cognitive, motor and speech impairment and spastic quadriplegia which were caused by a chicken Twister wrap from a KFC outlet in Sydney.
The New South Wales Supreme Court ruled in favour of the family a week ago and ordered KFC to pay Aus$8 million for damages to the girl plus legal costs.
In a statement by the family lawyer, George Vlahakis said they are relieved that the battle is finally over.
“Monika’s severe brain damage and severe disability has already exhausted the very limited resources of the family, Monika is now a big girl and they are finding it increasingly difficult to lift her and to look after her basic needs as well as look after Monika’s younger siblings. The compensation ordered is very much needed. KFC have to date been determined that Monika does not receive a cent.” George Vlahakis said.
KFC indicated last week that, they will appeal the court ruling but is yet to do so.
Trial judge Justice Stephen Rothman said “the chicken became contaminated because of the failure of one or more employees of KFC to follow proper preparation rules” he described the incident as “negligent”.
Kentucky Fried Chicken is a chain of fast food restaurants based in Louisville, United States. KFC has been a brand and operating segment since 1997 when that company was spun off from PepsiCo as Tricon Global Restaurants Inc.
KFC primarily sells Chicken pieces, wraps, Salad and sandwich. While its primary focus is Fried Chicken, KFC also offers a line of grilled and roasted chicken products, beside dishes and desserts. Outside the USA, KFC offers beef based products such as hamburgers or kebabs, poutine, pork based products such as ribs and other regional fare.
The company was founded as Kentucky Fried Chicken by Colonel Harland Sanders in 1952.
