Status of The Court (Uk)

The UK courts are divided in several parts, the decision of higher courts is bidding for lower courts. While decision of lower courts is persuasive for higher courts.

Magistrates Court

It starts with Magistrates Court. The magistrate court is bound by the decision of High court, Court of Appeal, House of Lords also known as Supreme Court for the United Kingdom and The European Court of Justice. On the other hand the decision of the Magistrate court is not binding for any court not even for itself.

County Court

After Magistrate court The County Court existed. The County court is bound by the decision of High court, Court of Appeal, House of Lords also known as Supreme Court for the United Kingdom and The European Court of Justice. On the other hand the decision of the County court is not binding for any court not even for itself.

Crown Court

From bottom to top the third number is of Crown Court. The Crown court is bound by the decision of High court (QBD), Court of Appeal, House of Lords also known as Supreme Court for the United Kingdom and The European Court of Justice. On the other hand the decision of the Crown court is not binding for any court. However, its decision are reported more widely and are more authoritative.

 High Court

After Crown Court The High Court undertake the cases. The High Court Consist of divisions like

1.Queen’s Bench

2.Chancery

3.Family

The decision of High court held any one of them

1. Judge Sitting alone 

2. Judge Sitting Together (Divisional Court)

Judge Sitting Alone

The decision by High Court where Judge Sitting alone is bound by Divisional Court, The Court of Appeal, House of Lords and European Court of Justice. While its binding for Magistrate Court, County Court and Crown Court.

 Judge Sitting Together (Divisional Court)

The decision by High Court where Judge Sitting Together is bound by any Divisional Court, The Court of Appeal, House of Lords and European Court of Justice. While its binding for Magistrate Court, County Court, Crown Court and Divisional Court.

The Decision of High Court where Judge Sitting together is bidding for High Court Where Judge Sitting Alone.

The Court of Appeal

The Court of Appeal is bound with the decision of House of Lords and European Court of Justice and also by its own decision. On the other hand its decision is bidding for all inferior courts and itself as well.

The House of Lords

The House of Lords is bound only with the decision of European court of Justice and itself. The decision of House of Lords is bidding for All English Courts and itself.

The European Court of Justice

The decision of ECJ is not bound by any court not even itself and All English Courts decisions are bound by ECJ.
